OVERVIEW

Forget Me Not – Memorial Jewellery is a business specialising in creating personalised memorial jewellery and keepsakes. These Terms and Conditions govern your use of our website and services. By placing an order with us, you agree to be bound by these terms.

DEFINITIONS

“We,” “Us,” “Our,” or “Forget Me Not – Memorial Jewellery” refers to Forget Me Not – Memorial Jewellery and its owners, employees, and representatives.
“You,” “Your,” or “Customer” refers to the individual or entity purchasing products or services.
“Product(s)” refers to any memorial jewellery or keepsakes created by Forget Me Not – Memorial Jewellery.
“Material(s)” refers to any biological materials, including but not limited to ashes, hair, cord tissue, or other personal materials provided by customers for inclusion in products.

ORDERING PROCESS

1. Order Placement

By placing an order with Forget Me Not – Memorial Jewellery, you confirm that:

  • You are at least 18 years of age.
  • You have the legal right to provide all materials sent to us.
  • All information provided is accurate and complete.
  • You accept these Terms and Conditions.

2. Material Submission

  • All materials must be submitted according to our packaging and preservation guidelines, which will be provided upon order confirmation.
  • Materials must be clearly labelled with your order number, address, and full name.
  • We reserve the right to refuse any materials that appear contaminated, improperly preserved, or otherwise unsuitable for production.
  • We are not responsible for materials lost or damaged during shipping to our facility.
  • Please don’t send the last of anything in case items go missing.

3. Production Timeline

  • Standard production time is 10-14 weeks from receipt of all required materials and payment.
  • Custom or complex orders may require additional time.
  • Production timelines are estimates and not guarantees. Seasonal demand may affect completion times.

4. Payment

  • Full payment is required to secure your order.
  • Orders will not be processed until payment is received.
  • Payment methods accepted include credit/debit cards, PayPal, and bank transfers.

PRODUCT INFORMATION

1. Product Variations

  • Each piece of memorial jewellery is handcrafted and unique.
  • Natural variations in colour, texture, and appearance are expected and not considered defects.
  • The final appearance may differ slightly from sample images due to the unique nature of biological materials.

2. Material Processing

  • We use specialised preservation techniques to process ashes and other biological materials.
  • We cannot guarantee that all biological properties of the materials will be preserved.
  • The appearance of preserved materials may change over time due to natural aging processes.

REFUND AND RETURN POLICY

1. Custom Products

  • As all our products are custom-made with your personal materials, we do not offer refunds once production has begun.
  • Deposits are non-refundable once materials have been processed.

2. Cancellations

  • Orders may be cancelled within 48 hours of placement for a full refund.
  • Orders cancelled after 48 hours but before material processing may receive a partial refund, less a 20% administrative fee.
  • Orders cannot be cancelled once materials have been processed.
  • There are no refunds or replacements on rings ordered in the wrong size. We highly recommend you check your size with your local jeweller for the most accurate measurement. We can provide a printable international ring sizer, but it is used at your own risk.

3. Product Issues

  • If you receive a product with manufacturing defects, please notify us within 7 days of receipt.
  • Please provide clear photographs of the defect for our assessment.
  • If we confirm a manufacturing defect, we will offer repair or replacement.
  • Normal wear and tear, damage from improper handling, or changes due to natural aging are not considered defects.

4. Repairs

  • We offer a one-year warranty against manufacturing defects.
  • Repairs needed due to customer handling or accidents will incur additional charges.
  • Customer is responsible for shipping costs to return items for repair.

SHIPPING POLICY

1. Shipping of Finished Products

  • All orders are shipped via tracked delivery services with sign-on delivery.
  • Shipping is free Australia-wide. A $15 flat rate applies to international orders.
  • International shipments may be subject to customs duties and taxes, which are the customer’s responsibility.

2. Delivery Timeframes

  • Domestic shipments typically arrive within 3-7 business days after dispatch.
  • International shipments may take 7-21 business days depending on the destination.
  • Delivery timeframes are estimates and not guarantees.

3. Lost or Damaged Shipments

  • We are not responsible for delays caused by shipping carriers or customs.
  • In case of lost or damaged shipments, we will assist in filing claims with the shipping carrier.
  • Please inspect all products upon receipt and report any shipping damage within 48 hours.

Privacy Policy

1. Information Collection

We collect the following types of information:

  • Contact information (name, email, phone number, shipping address).
  • Payment information.

  • Biological materials you provide.

  • Materials not used in production are returned to you with your completed piece. Ashes are not returned.

  • We never share, sell, or repurpose your biological materials.

INTELLECTUAL PROPERTY

1. Ownership

  • All designs, images, and content on our website are the intellectual property of Forget Me Not – Memorial Jewellery.
  • Reproduction or use of our designs without written permission is prohibited.

2. Customer Photos

  • If you share photos of your Forget Me Not – Memorial Jewellery products on social media or directly with us, you grant us permission to use these images for marketing purposes unless you explicitly state otherwise.
  • We will always request permission before using customer photos for promotional materials.

LIMITATION OF LIABILITY

1. Product Use

  • Our products are decorative items and not intended for children or infants.
  • We are not responsible for any allergic reactions or other adverse effects resulting from wearing or handling our products.

2. Maximum Liability

  • Our maximum liability for any claim arising from our products or services shall not exceed the purchase price paid.
  • We are not liable for any indirect, incidental, or consequential damages.

CHANGES TO TERMS AND CONDITIONS

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after such changes constitutes acceptance of the updated terms.

GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Queensland.

Disclaimer

I cannot guarantee any specific outcomes. Please allow for variations in the final presentation of your piece.

All resin is hand poured and as such may have some small noticeable bubbles and tiny indentations on the surface.  These are created by bubbles bursting as the resin dries and also by the inclusions within the resin. This is unavoidable, barely noticeable and only adds to the uniqueness of your piece.

Frequently Asked Questions

Almost all jewellery is set in sterling silver and clearly labelled as such. Some pieces are also available with rose gold or yellow gold plating.  There is also the option to make some items in solid gold.  Please get in touch for more details

Once you have chosen and ordered the jewellery you would like I will email you my address and packaging instructions  Your inclusions and effects are added in layers according to your preference and what you would like visible.  Only the highest quality jeweller’s resin is good enough for the purpose of creating memorial jewellery. 

 I have had no experience with any of the pieces I have created changing colour unless poorly cared for.  I offer a 12-month warranty but your jewellery is designed to last a lifetime.  It is not advisable to expose resin to harsh chemicals such as chlorine or direct UV light for long periods.  With normal wear, you should have no issues.  There is the option to add our new waterproof coating and increase your warranty to two years if you wish. This allows you to wash your hands and shower etc without having to worry about removing your keepsake.

The waterproof coating provides extra protection against freshwater, allowing you to wear your jewellery while washing your hands, showering, and during similar activities.

It also extends the warranty from one to two years. However, it has not been tested in chlorine, salt water, or with chemicals, so exposure to these should be avoided. Please refer to the care guidelines for more details.

The turnaround time varies depending on a few factors but is generally a maximum of ten to fourteen weeks from when I receive your inclusion. This is an outside estimate and many pieces are completed much quicker.  I will keep you informed at every stage of the process and if I am expecting any delays then I will notify you.  

Please send around one teaspoon of ashes. Any that are unused will be sent back to you with your jewellery. Nothing is discarded. If you are sending flowers then just a few petals are enough and if you are sending hair then please include enough to pinch between two fingers at around 3+cm length.

A good pinch of animal fur/hair is adequate.

Your inclusions are treated with warmth and respect the entire time.

You will receive a detailed email with everything you need to know after I receive your order.

Cremation ashes, hair/fur, soil, sand, fabric, breastmilk or flowers. If you have any other suggestions please get in touch and we’ll see what we can create together.

Please send around a teaspoon of ashes in a small plastic bag. A sandwich bag is ideal. Then put it inside another sandwich bag so any leakage is contained. This process also applies to soil and hair. Petals should be wrapped in a napkin or paper towel prior to going in a sandwich bag. You will receive an email containing the address to send your inclusion to after I receive your order.

I’ll let you know when I receive your inclusion and I’ll keep you posted at each step of the process. When it is ready to ship I’ll send you tracking details.

Your jewellery metal may need a polish from time to time. Use the complimentary polishing cloth provided. Don’t polish the resin itself as it may make it dull.

Resin should not be exposed to chemicals such as hand sanitiser, hairspray, washing up liquid, sunscreen or chlorine. It is best removed before showering and swimming. Store out of UV light as long exposure may cause your piece to discolour. Good care will see your piece last a lifetime. If you regularly have your hands in water, a pendant may be a better choice for you.   Alternatively you might choose to upgrade to our two year warranty with waterproof coating. A care card is included with your jewellery.

Yes, a no questions asked 12-month guarantee. If you have any issues simply send your piece back to me and I will replace or repair it. If the piece you bought is no longer in stock then I will offer an alternative.  If you have upgraded to our waterproof coating then you will receive a two year guarantee from the day you receive your keepsake.

Tracked shipping of your jewellery via courier or Australia post is free within Australia. Solid gold items and those containing precious stones will be tracked and insured. International shipping is a flat $15 AUD. You are responsible for shipping costs to get your inclusion to me. I recommend using registered post. There is always the danger things may be lost in the post so please don’t send me the ‘last’ of anything.

Your inclusion will be labelled when I receive it and the label will stay with it throughout the entire jewellery creation process. There is no room for error with the safety processes that I have developed.

Yes, for a flat fee of $15 I will post internationally. It is your responsibility to post your inclusion to me.

Solid gold and precious stones will be tracked and insured.
